Terms of Use

These Terms of Use (“Terms”) are an agreement between you and Benchi (“Benchi,” “we,” “us,” or “our”) governing your use of the Benchi website, applications, and vehicle-negotiation service (the “Service”).
By creating an account, starting a negotiation, or otherwise using the Service, you agree to these Terms.
What Benchi does
Benchi helps you negotiate a vehicle lease.
You tell us the vehicle you are looking for, your preferred lease structure, and other information relevant to your search. Benchi may contact multiple dealerships, request and compare lease offers, negotiate with dealerships, and present the resulting offers to you.
Alex, the agent that writes and responds to dealership emails, is an AI agent. Alex identifies itself as an AI Leasing Advisor in its initial outreach to dealerships.
Benchi does not pretend to be you and does not represent Alex as a human.
What Benchi is not
Benchi is not a motor vehicle dealer, leasing dealer, lender, lessor, insurance provider, or party to your vehicle lease.
Benchi does not sell or lease vehicles, extend credit, approve financing, take possession of vehicles, or receive title to vehicles.
Benchi does not sign dealership documents or lease agreements for you.
If you choose to proceed with an offer, the actual vehicle transaction is between you and the applicable dealership, lender, lessor, and any other parties identified in their paperwork.
The dealership is responsible for the accuracy of the offer it provides and for honoring any commitments it makes. You are responsible for reviewing the final lease agreement and confirming that its terms match what you expect before signing.
Nothing provided by Benchi is financial, tax, legal, insurance, or investment advice.
Your account
You must be at least 18 years old and legally capable of entering into a binding contract to use the Service.
You are responsible for keeping your account and sign-in credentials secure. Activity performed through your account may be treated as activity authorized by you.
You agree to provide accurate and current information.
The information you provide—including your ZIP code, desired vehicle, lease term, mileage allowance, credit band, incentives, trade-in information, and payment preferences—may be communicated to dealerships and used to negotiate your offers.
Incorrect or incomplete information may cause a dealership to revise or withdraw an offer.
The success fee
Benchi charges one success fee per negotiation.
You owe the success fee only if Benchi secures at least one qualifying offer, as defined below, during that negotiation.
If Benchi does not secure a qualifying offer, you owe no success fee.
You are not charged when the negotiation starts.
When you start a negotiation, your payment method is saved through our payment processor and you authorize Benchi to charge it later if the success-fee conditions are satisfied.
The exact success fee is displayed before you authorize the negotiation. That amount is locked to that negotiation and will not change afterward, even if Benchi changes its pricing for future negotiations.
The success fee is compensation for the negotiation service and for securing a qualifying offer. It is not contingent on you ultimately signing a lease.
If Benchi secures a qualifying offer and you decide not to accept it, the success fee is still earned.
What counts as a qualifying offer
A qualifying offer is a genuine, concrete lease offer from a dealership that reasonably matches the vehicle and lease structure you asked Benchi to shop for and contains enough information to evaluate the deal.
A qualifying offer will ordinarily identify or establish the material terms necessary to evaluate the lease, including, as applicable:
- the vehicle, trim, or specific inventory unit being offered;
- the monthly payment;
- the lease term;
- the mileage allowance;
- the amount due at signing or other upfront payment;
- material incentives or eligibility conditions; and
- other material conditions attached to the offer.
Not every dealership response is a qualifying offer.
The following do not, by themselves, qualify:
- a dealership merely replying to an email;
- a request that you visit the dealership before receiving numbers;
- an advertisement or advertised special;
- a generic payment estimate;
- an offer that is too incomplete to evaluate;
- an offer for a materially different transaction unless you expressly authorized Benchi to consider alternatives; or
- an offer that depends on an incentive or eligibility requirement that Benchi knows you do not satisfy.
Your target monthly payment is a negotiation goal, not a guarantee.
A valid qualifying offer does not need to meet or beat your target payment.
Benchi does not guarantee that it will reach your target, obtain the lowest possible price in the market, achieve a particular amount of savings, or obtain any offer at all.
Dealer changes and withdrawn offers
Vehicle availability, manufacturer programs, incentives, money factors, residual values, taxes, fees, and dealership decisions can change.
A dealership may therefore revise or withdraw an offer after initially providing it.
If an otherwise qualifying offer was genuine and available when Benchi secured it, a later change by the dealership does not automatically mean the offer was never qualifying.
However, if we determine that an offer was materially inaccurate, was not actually available when presented, depended on undisclosed conditions, or otherwise should not reasonably have been treated as qualifying, we may reverse the success fee.
Payment
Payments are processed by Stripe.
Your full card number and security code are submitted directly to Stripe and are not stored on Benchi’s systems. Benchi may retain limited payment-method information supplied by Stripe, such as a payment-method identifier, card brand, expiration information, and the last four digits of the card.
If an authorized success-fee charge fails, you may be asked to update or retry your payment method.
While an earned success fee remains unpaid, Benchi may prevent you from starting additional negotiations.
Refunds
If no qualifying offer is secured, no success fee is owed.
Once a success fee has been properly earned, it is generally non-refundable simply because you decide not to accept the offer, change your mind about leasing, obtain another vehicle elsewhere, or decide not to complete a transaction.
We will refund or reverse a charge when:
- you were charged more than once for the same fee;
- you were charged even though no qualifying offer was secured;
- we determine that the offer used to trigger the fee did not meet the qualifying-offer requirements above;
- the charge resulted from a Benchi billing error; or
- a refund is otherwise required by applicable law.
If you believe a charge was made incorrectly, contact support@benchi.io and tell us which negotiation and charge you are questioning.
Nothing in this refund policy limits any non-waivable rights available to you under applicable consumer-protection law.
Stopping a negotiation
Once a negotiation becomes active, Alex may already be communicating with several dealerships.
For that reason, an active negotiation may not always be cancellable directly through the app.
If your circumstances materially change and you want Benchi to stop an active negotiation, contact support@benchi.io. We will make reasonable efforts to stop further outreach and negotiation.
Stopping a negotiation does not undo a success fee that was already earned because a qualifying offer had been secured before the negotiation was stopped.
Using the Service properly
You agree not to:
- start a negotiation when you are not genuinely considering leasing a vehicle;
- use Benchi primarily to collect dealership quotes that you have no intention of considering;
- use Benchi primarily to obtain leverage for a transaction being conducted by someone else;
- intentionally provide false information to Benchi or a dealership;
- impersonate another person;
- start a negotiation for another intended lessee without accurately disclosing that fact;
- use the Service for fraudulent, deceptive, abusive, or unlawful activity;
- interfere with or disrupt the Service;
- attempt to circumvent security or usage restrictions;
- access the Service through unauthorized automated means;
- scrape or systematically extract data from the Service except as expressly permitted by us; or
- reverse engineer or attempt to derive non-public source code, models, prompts, or system logic from the Service except to the extent such a restriction is prohibited by law.
We may suspend or terminate access when we reasonably believe the Service is being misused.
Limits on simultaneous negotiations
Benchi may limit how many negotiations you can have running at the same time.
Each negotiation involves real communication with dealerships, so these limits help prevent abuse and protect Benchi’s ability to negotiate effectively on behalf of its customers.
The applicable limit may change over time and may be displayed in the Service.
Email and dealership communications
Benchi sends transactional communications related to your account and negotiations, including notifications that a negotiation has started, that an offer has arrived, or that a payment has succeeded or failed.
Alex communicates with dealerships using Benchi-controlled email addresses rather than pretending to send messages from your personal email address.
Depending on the options available when you start the negotiation, you may be able to receive copies of dealership correspondence.
Dealership emails and attachments sent to Benchi may be automatically processed, classified, summarized, and interpreted using AI systems.
AI and automated processing
Benchi uses artificial intelligence and other automated systems to read dealership communications, interpret offers, compare lease terms, negotiate, and generate responses.
AI systems can make mistakes.
Benchi may incorrectly interpret an email, attachment, image, number, incentive, vehicle configuration, or other information supplied by a dealership.
You should review any offer before relying on it and carefully review the dealership’s final paperwork before signing.
If there is a conflict between information displayed by Benchi and the final transaction documents provided by a dealership or lessor, the final documents you choose to sign govern your vehicle transaction.
Third-party services
The Service may rely on third-party services, including payment processors, email providers, data providers, vehicle inventory providers, and dealerships.
Benchi does not control those third parties and is not responsible for their independent acts, omissions, availability, products, services, or terms.
Your dealings with a dealership or other third party may be governed by separate agreements between you and that third party.
No warranty
To the fullest extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis.
Benchi does not warrant that the Service will always be available, uninterrupted, error-free, or accurate.
Benchi does not guarantee:
- that any dealership will respond;
- that any dealership will make an offer;
- that any particular vehicle will remain available;
- that a dealership will honor or continue to honor an offer;
- that dealership-provided information is accurate;
- that Benchi will identify every available incentive or offer;
- that Benchi will obtain the best offer available in the market; or
- that you will ultimately qualify for or complete a particular lease.
Final lease eligibility may depend on matters outside Benchi’s control, including credit approval, lender requirements, residency, incentive eligibility, vehicle availability, taxes, registration requirements, and dealership policies.
Limitation of liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability arising from fraud, willful misconduct, gross negligence, or violation of non-waivable consumer rights.
Subject to the preceding paragraph, Benchi will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the Service, including lost savings, lost opportunities, loss of data, or losses resulting from a dealership’s refusal to complete a transaction.
Subject to the same limitation, Benchi’s total liability for claims arising out of or relating to a negotiation or the Service will not exceed the greater of:
- the amount you paid Benchi during the 12 months preceding the event giving rise to the claim; or
- $500.
This section is intended to allocate risk between you and Benchi and does not waive any remedy or right that applicable law does not permit you to waive.
Changes to these Terms
We may update these Terms from time to time.
The current version will display its effective date at the top.
If we make a material change that requires your agreement, we will ask you to review and accept the updated Terms before you start another negotiation.
Unless we expressly tell you otherwise, a negotiation already in progress remains subject to the version of the Terms you accepted when that negotiation started.
Benchi may retain a record of the Terms and authorizations associated with each negotiation.
Governing law and disputes
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law principles.
Any court proceeding arising out of or relating to these Terms or the Service will be brought in a state or federal court located in New Jersey, and you and Benchi consent to the jurisdiction of those courts.
You may also bring an eligible claim in small claims court.
Nothing in this section limits any non-waivable rights or protections you may have under applicable consumer-protection law.
Entire agreement
These Terms, together with any terms or disclosures expressly incorporated into them when you start a negotiation, constitute the agreement between you and Benchi concerning the Service covered by these Terms.
If a provision of these Terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
